It will be necessary to prove these facts by authentic documents ...' Refers to Countess of Sutherland's Additional Case as 'drawn up by the most accurate Historian of Scotland, Sir David Dalrymple then Lord Hailes'. Refers to the Case of 1633 concerning Earldom of Strathearn and Menteith and to Scotstarvet [Scotstarvit, laird of] and Durie's Decisions. Suggests 'consulting the original pleadings which probably still exist'.

Early sixteenth century transumpt of charter of William I granting to Richard de Montfiquet (Muschet) the lands of Cargill, Perthshire, as fully as when the King held it in his own hands on the day he granted it; and in addition Kincardine in Menteith, Perthshire; to be held in feu and heritage, with soke and sake, pit and gallows, toll, team and infangthief, for the service of one knight. Richard may hold Cargill in forest, and no one may hunt or cut down wood there without his permission, on the king's forfeiture of ten pounds. Given at Perth. Witnesses: Hugh [of Roxburgh], chancellor; Duncan Earl [of Fife], justiciar; Richard, clerk of the Provend; Gilbert Earl [of Strathearn]; William de Moreville, constable; Alan son of Walter, steward; William de Hay; Adam of Ceres; Hugh of Calder; Roger de Mortemer; Duncan of Ceres; Herbert the marischal. At the foot is a notarial note signed by Gavin Dunbar stating that the original having been read before the Lords of Council it was ordered to be transumed, on account of its age and fragility, by Master Gavin Dunbar, clerk of the rolls, register and council.
