The letters (of Horning) dated 2nd and signet 3 February 1635. (Dame Janet Ker Summoned 14 April 1635 and put to the Horn at Irvine 17 July 1635. Contract of marriage between William Earl of Glencairn with consent of Dame Janet Ker Countess of Glencairn his mother on the one part, and Mrs Anna Ogilvie (lawful) daughter of James Lord Deskfurd with consent of the said James Lord Deskfurd her father and Dame Elizabeth Leslie her mother on the other part In contemplation of which marriage the Earl with consent of his mother obliges him his heirs as well male taillie and of provision etc to infeft the said Mrs Anna Ogilvie his future spouse in liferent in the lands of Finlayston Cunningham with the castle etc For which causes Lord Deskfurd obliges him to pay to the Earl in name of Dote with the said Mrs Anna Ogilvie within the burgh of Edinburgh the sum of 40,000 merks etc. Witnesses, Sir William Cunningham of Robertland knight, baronet, Sir Alexander Abercrombie of Berkenbog knight baronet, Mr. William Cochrane of Coudon, Mr Robert Hepburn advocate and William Sharpe Sheriff Clerk of Banff. At Cullen. (Signature of Dame Janet Ker is to be obtained. Provision is made for the daughters of the marriage if no son thereof is born) (Failing Lord Deskford and his wife, John Earl of Rothes, John Leslie of Newton, Sir Patrick Ogilvie, elder and younger of Inchmartin, and Alexander Ogilvie of Kempcairn, brother german of Lord Deskford are to fulfil the contract).

Gift by King Charles 1st to William Earl of Glencairn, his heirs as assignees one or more, of the liferent escheat of all lands heritages etc pertaining to Dame Janet Ker Countess of Glencairn (his mother) of all years and terms bygone from the expiry of year and day after the said Countess her denunciation to the horn (which took place on 17 July 1635 at the instance of John Inglis (See GD39/1/269). Her letters obligatory being dated 17 July 1633 and registered in Books of Council 2 Feb. 1635), etc. At Holyroodhouse.

Decree of declarator obtained before the Lords of Council and Session at the instance of William Earl of Glencairn against Colonel Robert Cunningham (lawful) son of umquhile Dame Janet Ker Countess of Glencairn and (Lady - Cunningham) Ladies Margaret, Jean, Anne and Marion Cunningham, (Lawful) daughters of the Countess, and nearest in kin to her, Sir Ludovick Stewart of Minto husband of Lady Cunningham , David Beton of Creick, husband of Lady Margaret and John Blair of that ilk, husband of Lady Jean making mention that the Earl had by Gift of our sovereign Lord (See GD39/1/273) the liferent escheat of all lands heritages etc which pertained to the said Countess with the maills farms annualrent etc of all years and terms bygone since the expiry of year and day after the Countess her denunciation to the horn, and of all years and terms thereafter during her lifetime, pertaining to his Majesty by reason of the Countess having upon the 17 July 1635 been denounced rebel and put to the horn by virtue of letters of horning (See GD39/1/269) against her at the instance of John Inglish merchant burgess of Edinburgh for not making payment to him of £770:4/2 (Sic but £1170) etc. as the letters of horning etc did at more length bear, and as the letters of gift to the said William Earl of Glencairn under the privy seal of date 22d January 1640 and also more fully purport. By virtue whereof the Earl had good and undoubted right to the foresaid liferent escheat etc. (Edinburgh).
