Volume entitled 'The Arniston Papers: A Collection of Miscellaneous Documents, Appointments as Judges, Bonds of Provision, Wills, Marriage Contracts etc Belonging to Robert Dundas Esq of Arniston, 1857'. This consists of a selection from the Arniston muniments inlaid into a finely bound leather volume. The descriptions are principally based on those prefixed to the volume without re-examination of the documents themselves. In a few instances, where the decriptions were clearly defective, the documents themselves were clearly examined. These decriptions have been summarised for the purposes of the electronic catalogue - the full catalogue can be viewed in the Search Room.
I. Miscellaneous Documents, 1538-1713 1. 1538/1539 Feb 7 Precept of clare constat by Walter, lord St John, Preceptor of Torphichen, Knight of the Order of Jerusalem etc for infefting John Megot in temple lands in Ouchterstoun in the barony of Ballintrudo, shire of Edinburgh. [Folio 1] 2. 1571 May 25 Assignation by James, Lord of Torphichen to George Dundas of that ilk, and James Dundas, his son, of the granter's right of redemption of 3/4 of the town and lands of Arnetstoun, from Michael Borthuik [Borthwick] of Glengelt. [Folio 2] 3. 1581 May 30 Procuratory by George Dundas of that ilk warning Michael Borthwick of Glengelt to appear in the kirk of St Giles, Edinburgh, to receive £3100 for redemption of 3/4 of the town and lands of Arnetstoun. [Folio 3] 4. 1573 Jul 9 Contract between Dorothy Lundy, relict of Ninian Liddell of Halkerstoun and others, and John Pentland in Halkerstoun whereby the first parties remit to John Pentland all criminal and civil action they could raise against him for the slaughter of Ninian Liddell for the half of the lands of Halkerstoun. [Folio 4] 5. 1576/1577 Contract between George Dundas and his spouse, Katherine Oliphant, and Archibald Brysoun in Hudispeth and Margaret McDowgall, his spouse for liferent of the lands called Hudispeth and Michelislandis. [Folio 5] 6. 1578 Mar 31 Precept by Katharine Olyphant, lady Dundas for warning Gavin Huntar in the Tempill and Mr Nicol Elphingstoun of the Schank, to remove from the lands of Hudispeth.[Folio 6] 7. 1586/1587 Mar 24-28 Precept by George Dundas of that ilk for warning the tenants of the Mains of Arnistoun to remove. [Folio 7] 8. 1587/1588 Jan 27 Discharge by Mr Thomas Hamiltoun, advocate [later 1st Earl of Haddington], son and heir to Thomas Hamiltoun of Preistisfeild, and spouse to Margaret Borthuik, to George Dundas of that ilk for £811, rents of 3/4 of the town and lands of Arnestoun, for crops and years 1585 and 1586. [Folio 9] 10. 1588 May 25 Renunciation by Margaret Borthuik with consent of Mr Thomas Hamiltoun, her spouse, to George Dundas of that ilk of 3/4 of the town and lands of Arnestoun. [Folio 10] 11. 1598 Jul 24 Tack by James, lord Borthwick, patron of the church of Borthuik, with consent of Mr John Murray, minister there, to John Liddell of Halkerstoun of the teind sheaves of the town and lands of Eister Halkerstoun and of Wester Halkerstoun called Cassiltoun. [Folio 11] 12. 1598/1599 Feb 1 Assignation by John Elphingstoun of the Schank and Elizabeth Edmestoun, his mother and of James Hoppringill of Torsons, her spouse, to William Oliphant, brother to late Laurence, lord Oliphant of all tacks of teinds of the lands of Birkensyde etc. [Folio 12] 13. 1612 Apr 28 Disposition by William Oliphant to James Dundas, son and apparent heir to Sir James Dundas of Arniston, of the tacks and teinds of the lands of Birkensyde etc, see no.12. [Folio 13] 14. 1606 Jun 4 Disposition by the minister, elders and parishioners of the Kirk of Borthuik with consent of the Presbytery of Dalkeith to Sir James Dundas of Arnestoun of the Revestry of the Kirk of Borthuik as a burial place for 250 merks. [Folio 14] 15. 1606 Aug 12 Ratification of disposition by the Provincial Assembly of Lothian and Tweeddale, see no.14. [Folio 15] 16. 1608 Ratification of disposition (see no.14) by the Heritors of the parish of Borthwick, including the Earl of Lothian, lord Yester. [Folio 16] 17. 1615 Jun 16 Renunciation by Sir James Dundas, eldest son of Sir James Dundas of Arnistoun, in favour of his father of his right to the Maynes of Arnistoun. [Folio 17] 18. 1629 Nov 14 and 26 Procuratory by Elizabeth Cokburne with consent of Alexander Home in Northberwick, her spouse, and of William Cokburne, her brother, for resigning her lands of Tempill in favour of Stephen Boyd, merchant burgess of Edinburgh. William Drummond of Hawthornden, the poet, is a witness to this and nos 19 and 20. [Folio 18] 19. 1629 Nov 26 Obligation by Mr William Cokburne, brother of Francis Cokburne of Tempill, to deliver the writs of Tempill to Stephen Boyd. [Folio 19] 20. 1629 Nov 17 Obligation by Mr William Cokburne to said Stephen Boyd to rid the lands of Tempill of incumbrances. [Folio 20] 21. 1630 Aig 9 Signature under the cachet of Charles I for a charter under the Great Seal in favour of Sir James Dundas of Arnistoun of the lands of Howburne. [Folio 21] 22. 1646 Jan 6 Contract of marriage between Sir John Scot of Scottistarvet, Director of Chancery, SCJ and Ewphame Monypenny, relict of William Rig of Etherne, with consent of Sir James Monypenny of Pitmillie, her brother, whereby following marriage Sir John Scot assigns the teind sheaves of the barony of Schank in the sheriffdom of Edinburgh with 300 merks annually for her lifetime to his wife. [Folio 28] 27. 1736-1737 Mar 24 Letter under the Sign Manual of George II to the President of the College of Justice and the Senators thereof, nominating Robert Dundas of Arniston one of the Ordinary Lords of Session. Countersigned 'Holles Newcastle'. [Folio 30] 28. 1742 Aug 11 Letter under the Sign Manual of George II to the President of the College of Justice and the Senators thereof, directing them to place a seat within the Bar for Mr Robert Dundas, advocate, from whence he might be at liberty to plead cases. [Folio 32] 29. 1748 Jun Letter under the Sign Manual of George II to the Extraordinary Lords and others, the Senators the College of Justice nominating Robert Dundas of Arniston to be President of the College of Justice. Countersigned 'Bedford'. [Folio 34] 30. 1756 Aug 16 Copy warrant under the Sign Manual of George II addressed to the Barons of Exchquer requiring them to pay £600 per annum out of any revenues of Scotland for 7 years for behoof of the children of the deceased Robert Dundas, late President of the Court of Session. [Folio 36] 31. 1760 Apr 30 Letter under the Sign Manual of George II to the Extraordinary Lords and others, the Senators the College of Justice nominating Robert Dundas of Arniston, the King's Advocate to be constant President of the College of Justice in absence of the Chancellor. Will dated 28 Apr 1627. [Folio 51] 40. 1650 Dec 5 Testament of Sir James Dundas of Arnestone, appointing Robert Dundas his only son, his executor. [Folio 55] 41. 1679 Jan 11 Testament testamentar confirmed by the Commissaries of Edinburgh and inventory of the goods etc of the deceased Sir James Dundas of Arniston, who died in Sep 1679. Will dated 10 Jan 1674. There is an Eik of 25 Feb 1697. Contracts of Marriage etc., 1617-1787. 44. 1617 Jan 24 Contract of marriage between Sir Gideon Murray of Elibank, treasurer depute, and Sir Patrrick Murray of Langshaw, his eldest son on one part, and Sir James Dundas of Arnistoun for himself and on behalf of Elizabeth, his daughter, for the marriage of Sir Patrick Murray and Elizabeth Dundas. 45. 1619 Jul 7 Contract of marriage between Sir James Dundas of Arnistoun and Sir David Home of Wedderburne for the marriage of Sir James Dundas and Mary Home, youngest sister of Sir David Home.
