Title |
Procuratory of Resignation by John Kennedy of Smithistoun, with consent of Margaret Cuninghame, his spouse, whereby they constitute and create John Muir their procurator for resigning the 40 shilling lands of Westir Smithistoun of old extent, with mansion house, yards etc., lying in the earldom of Carrik and sheriffdom of Air, into the hands of their superiors, James, perpetual commendator of the monastery of Melrose, and the convent thereof, and also into the hands of Alexander, commendator perpetual of the monastery of Culross, iconomus of the said James, in favour of John Kennedy of Pennyglen. Witnesses, Patrick Muir of Cloncard, John Davidsoun of Grenand, John Mure in Wodland, Maurice McMurrie in Drummorane, John McQuorne, minister at Stratoun, John Masoun and John Kennedy, notaries public. The writ is authenticated by the seal of Thomas Kennedy of Ardmillan, procured by the said John Kennedy, and by the seal of John Baird of Kilhinze, procured by the said Margaret Cuninghame, she and her husband not having seals of their own. It is also signed by the said John Kennedy and by the said Margaret Cuninghame notarially by the foresaid two notaries.
In dorso: Notarial Certificate under the hand of R. Prymrois narrating that John Muir, servitor of George Mak, writer in Edinburgh, procurator for the foresaid John Kennedy and spouse, passed to the personal presence of Alexander, commendator of Culros, co-adjutor of James, commendator of Melros, and there resigned into his hands the foresaid lands in favour of John Kennedy of Pennyglen, to whom the lands were re-granted and a charter made thereupon subscribed. Done in the dwelling house of the coadjutor on 25 July 1586. Witnesses, Mr. Henry Lewingstoun, brother of the coadjutor, James Mastertoun and John Stewart, his servitors, James Young of Calmonell and George Mak, notary public. |
