Title |
Indenture (in Scots) between John, Earl of Lennox and Lord Darnley, and Matthew Stewart, his son and heir apparent, on one part, and Elizabeth Menteith, spouse of deceased John Napier of Merchiston, as one of heirs and portioners of the earldom, and Archibald Napier, her son and heir apparent, on the other part, concerning division of Menteith's part of lands of earldom of Lennox and profits falling to her from superiority and tenandry of free tenants of the earldom. |

Description |
Menteith renounced to the earl all right to profits of superiority and tenandry of the quarter of the earldom belonging to her. The earl consented to her holding a quarter of the property of the earldom with fishings etc, her quarter to be in one unit as divided by crown brieves of division; and will give her £5 of land of old extent adjacent to her quarter, to be held blench of him. If either party needed to sell part of their lands, the lands would be first offered to the other party at a reasonable price before being made generally available. No leases of land would be made to lords or `strange men' dwelling outside the earldom. The earl and his son will maintain the Menteiths in all their righteous causes, particularly in peaceful possession of their quarter. Witnesses: Laurence, Lord Oliphant; Robert, Lord Lyle; Master John Stewart, parson of Kirkinner; Master Richard Lawson; John Ross; and John Halkerston. Signed by the earl and his son; their seals, excellent condition, appended. |
