Extract registered disposition and deed of entail by Robert Hamilton of Bourtreehill in favour of himself in liferent during all the days of his lifetime and Jean, Countess of Crawford, his eldest daughter in fee and failing her by decease to the heirs of tailzie aftermentioned viz Robert Lindsay, second son procreat between George, Earl of Crawford and Jean, Countess of Crawford and the heirs male lawfully to be procreat of his body, whom failing to Bute Lindsay third son procreat between the said Earl and Countess, and the heirs male lawfully to be procreat of his body, whom failing to any other younger son to be procreat of Jean Countess of Crawford in this marriage and the heirs male of their bodies successively, whom failing to the heirs male of the said Jean, Countess of Crawford of Crawford's body in any subsequent marriage, whom failing to Frances Hamilton, his second daughter spouse to Captain John Ferguson of Greenveill, in the shire of Ayr and the heirs male to be procreat of her body, whom failing to Margaret Hamilton his third daughter and the heirs male to be procreat of her body , whom failing to Eleanora Hamilton, his fourth daughter and the heirs male to be proceat of her body, whom failing to nearest heir male descended of the body of George, Lord Lindsay grandson of the said grantor, excluding always the person possessed of the peerage of Crawford and his apparent heirs on the said peerage and failing all other heirs male of George, Lord Lindsay to the poor himself who shall be obliged to denude in favour of his own second son upon his existence in manner therein after provided as to other heirs who may succeed to a peerage and failing the whole heirs male of the bodies of the said daughters to the oldest heirs female of the bodies of his said daughters to the eldest heirs female of the body of Jean, Countess of Crawford, without division, whom failing to the eldest heir female of the body of the said Frances Hamilton, without division, whom failing to the heir female of the body of the said Margaret Hamilton without division, whom failing to the heir female of the body of Eleanora Hamilton without division, whom failing to any other heirs female that might be procreated of the said granter's own body and the heirs of their bodies also without division, whom failing to his own nearest heirs and assignees whatsoever declaring always that through the whole course of succession as well as heirs of taillie as heirs whatsoever the eldest heir female and the descendants of her body shall exclude all other heirs portioners and shall succeed without division but always under the conditions provisions clauses irritant and resolutive and other burdens therein mentioned of inter alia the 5 merk land and Mains of Pearston (Perceton) commonly called Pearston Blair comprehending the 20s land of Dreghorn and Mureside, 10s Dreghorn and 40 penny land of the lands of Dreghorn which 10s land of Dreghorn and 40 penny land of Dreghorn are commonly called the merk land of Cousland with the tower, fortalice and manor place of Pearston Blair, with the houses, biggings etc. as also the Mill of Armsheugh otherwise called Frier Mill lying near the burgh of Irvine with astricted multures and sequels of Armsheugh and astricted multures of the lands of Douray, Roddinghall, Pottertoun and Holehouse, with all the parts, pendicles and pertinents thereunto belonging together with the teinds, parsonage and vicarage of the said whole lands and others above disponed excepting such teinds as are allocated furth thereof and in use to be paid to ministers of Irvine and Dreghorn, and the 15s land of Horsemuir and 40s land of Nether Castleton, with houses, biggings etc, lying within the parish of Irvine, former bailliary of Cunningham and sheriffdom of Ayr and which lands were formerly part of the barony of Stevenston, afterwards tenandry of Cambuskeith, as also the teinds, parsonage and vicarage of the foresaid lands of Balgray excepting and reserving to the minister of the gospel serving the cure at Irvine out of the said teinds, 10 bolls of meal and 2 bolls of bear, now in use to be paid to the said minister yearly as corresponding to the said lands, and likewise 20s land of Drummure with houses, biggings etc all lying within the parish of Pearston of old and now by annexation within the parish of Dreghorn and former bailliary of Cunningham and sheriffdom of Ayr and the property of lands and mailling of Damhead with the houses, biggings etc extending to [ ] pound land of old extent as the same was possessed by John Murthland and was formerly possessed by James Stevenson, bounded on the east by Cunninghamhead Park Dyke, the old mill lead on the side of Roddinghill land, on the north by the Water of Annick, and on the west by Andrew Tarbet's lands of Over Pearston and on the south by the lands of Braehead possessed by John Caldwell all lying within the parish of Dreghorn, former bailliary of Cunningham and sheriffdom of Ayr Recorded in the Register of Tailzies, 15th June and the Books of Counicl and Session, 5th July 1773 |
