Description |
Although Tutory and Curatory matters were often dealt with in the Commissary Court, it appears that in Argyll they were, almost invariably, dealt with in the Sheriff Court. The processes listed here include Edicts of Tutory and of Curatory, Summonses related to the production of inventories for minors, and one or two Brieves of Furiosity in which the subject was declared 'incompos mentis, prodigal and furious'. In the processes designated as 'Claim' the procedure was very similar to that in a Service of Heirs, with a Brieve from Chancery and an inquest with a jury (assize) of 15, the verdict being 'retoured' to Chancery. In the case of Edicts of Curatory, minors who had reached the age of 14 for boys or 12 for girls summoned two of their nearest of kin from father's and mother's sides before the Sheriff to have curators appointed. They were then entitled to nominate curators for themselves. An inventory of the estate would then be given up. |
