The Justiciary Court of Argyll was not part of the Sheriff Court but an independent court which took the place of the High Court of Justiciary in the West Highlands. The Duke of Argyll was hereditary Justiciar. The status and nature of the court is described in the introductions to 'The Justiciary Records of Argyll and the Isles 1664-1705', ed. John Cameron (Stair Society vol. 12, 1949), and 'The Justiciary Records of Argyll and the Isles 1664-1742', ed. John Imrie (Stair Society vol. 25, 1962). For some years after the Earl of Argyll's rebellion in 1685 the Commissioners of Justiciary for Keeping the Peace of the Highlands appear to have replaced the Justiciary Court of Argyll. The court was subsumed into the Western Circuit of the High Court of Justiciary as a result of the Heritable Jurisdictions Act of 1747. |
