The original manuscript was by Robert Scott, Writer to the Signet, Assistant to the Clerk Register and Clerk in the Exchequer in Edinburgh. Originally, the Bishops' Commissars, who judged a vast range of cases, were somewhat in limbo when their authority was removed in 1560 but they continued on. James Balfour, Parson of Flisk, ecclesiastical lawyer, and a Lord of Session, re-established the Commissary Courts with a system that received the Royal Charter of Queen Mary on 5 February 1563-4. The system lasted with minor changes until the Sheriff Courts emerged in 1824. |
